乡村振兴战略背景下农地流转中政府职能缺位的问题及对策

摘　　要：回顾了我国农村土地流转法律制度建设的过程及其对农村土地流转的促进作用,分析了农村土地流转过程中存在的制度建设相对滞后、规范管理相对欠缺、主动服务相对不足等问题;提出了在坚持“三大原则”的基础上,及时完善农地流转法律制度,强化有关合同管理和纠纷调处,健全农地流转中介组织和宣传机制等对策,以期有效解决农地流转中政府职能缺位的问题。This study reviews the legal system construction process of rural land circulation and its promotion to rural land circulation.It analyzes the problems in the process of rural land transfer,such as the relative lag in the system construction,the relative lack of standard management and active service.On the basis of adhering to the“three principles”,this paper proposes to timely improve the legal system of rural land circulation,strengthen the relevant contract management and dispute mediation and improve the intermediary organization and publicity mechanism of farmland transfer,so as to effectively solve the problem of the absence of government functions in farmland transfer.
