摘　　要：土地征收事关广大人民群众特别是农民的切身利益,其规范化、法治化水平是党和政府推进国家治理体系和治理能力现代化水平的重要内容。完善征地制度作为农村土地三项制度改革的一项重要内容,也是本次土地管理法修改的重中之重。回顾新中国成立以来我国征地制度的演变历程,对比新旧土地管理法关于征地制度的相关规定,可以看出新时代我国征地制度有了重大创新与发展。借鉴境外的一些做法,可以将管制性征收纳入征地制度,结合我国实际情况,增加对土地承租人、相邻权人的补偿。Land expropriation is related to the vital interests of the broad masses of the people,especially the peasants.Its standardization and the level of legalization are the important contents of the Party and the government to promote the modernization of the state governance system and governance ability.As one of the important part of the three system reforms of rural land,perfecting the land expropriation system is also the most important thing in the revision of the land management law.By reviewing the evolution of land expropriation system in China since the founding of the People’s Republic of China,and comparing the relevant provisions of the new and old land management law on land expropriation system,this paper discusses the innovation and development of land expropriation system in China in the new time.It is suggested that the Regulatory Takings should be included in the land acquisition system,and the compensation for the lessee and the neighboring right holders should be included.
