法治与德治的德摩根定律—一种走向共和的治理逻辑

摘　　要：国家治理体系和治理能力现代化必然“坚持依法治国和以德治国相结合”的命题,蕴含着“法治”与“德治”二者同质元素走向共和的治理逻辑判断。从命题的形式和实质逻辑来看,作为两种约束个体变元的“法治”与“德治”在“现代化”体内在关系的演算形式符合德摩根定律的合取否定式和析取否定式的数理推演逻辑,同时于此已然的形式逻辑清晰的描述判断条件外亦是有可确定的经验的普遍性知识的实质内涵支持:人的主体结构、群体的社会结构、国家的治理经验。因此,“法治与德治相结合”的治理模式存在着形式和内容的辩证统一,本质上是国家治理体系和治理能力现代化的必要条件,必然走向一种共和的治理逻辑。the modernization of national governing system and governing ability is bound to "insist on the combination of governing the country by law and governing the country by virtue", which contains the ruling logic judgment of "ruling by law" and"ruling by virtue". In terms of the formal and substantive logic of the proposition, the internal relationship between "ruling by law"and "ruling by virtue" in the body of "modernization", as two kinds of constraints on individual variables, conforms to the logic of mathematical deduction of the conjunction and disjunction negation of De Morgan’s laws. At the same time, the formal logic clearly describes the judging conditions and also supports the essential connotation of universal knowledge with definable experience: the main body structure of human beings, the social structure of groups, and the governing experience of the state. Therefore, the dialectical unity of form and content exists in the governance mode of "the combination of rule of law and virtue", which is in essence the necessary condition for the modernization of national governance system and governance capability, and is bound to move towards a kind of republican governance logic.
