摘　　要：公共卫生是影响人类发展的重要变量,面对疫情引发的多种危机,应推进公共卫生治理的现代化,并对其必要性、可行路径和理念引领进行解析。基于发展法学的分析框架,应从"发展问题-发展手段-发展目标"的视角,对应审视"公共卫生-治理-现代化"的问题,并将发展因素全面融入公共卫生治理。公共卫生作为"发展问题",与发展环境、国家的发展方向密切相关,应加强其治理的国际合作;唯有构建以"健康发展权"为核心、以发展为导向的治理体系,不断提升治理能力或"发展能力",强化健康、法治和发展三大理念的引领,方能促进公共卫生治理与经济社会发展的良性互动,实现公共卫生治理现代化的"发展目标",推动公共卫生法治建设和发展法学的发展。Public health is an important variable that affects human development.In the face of various crises caused by the epidemic,the modernization of public health governance should be promoted,and its necessity,feasible path and philosophy be analyzed.Based on the analytical framework of law and development,the issue of"public health governance modernization"should be examined from the perspective of"development issues-development means-development goals",and development factors should be fully integrated into public health governance.As a"development issue",public health is closely related to the development environment and the countrys development direction,and its international cooperation in governance should be strengthened;the only way is to build a development-oriented governance system with the"health development right"as the core and continuously improve governance ability or"development capacity",strengthening the guiding ideas of health,rule of law and development,can promote the benign interaction between public health governance and economic and social development,realize the"development goals"of modernization of public health governance,and promote the construction of public health under the rule of law and enhance the research on law and development.
