摘 要:劳动争议诉讼中存在大量证据未形成案件,劳动者难以获得证据,适用现有的民事举证制度,可能会产生司法不公。为保护劳动者合法权益,有必要针对此类案件引入举证责任减轻制度,以便诉讼的深入开展,进而保障诉讼程序能切实解决实体纠纷,实现公平正义。In labor dispute litigation,there are a large number of cases with unformed proof.The difficulty in obtaining proof on the side of the employees would lead to judicial injustice according to the existing proof system in civil law.In order to protect the legitimate rights and interests of employees,it is necessary to introduce the system of reducing the burden of proof in such cases,so as to carry out the litigation in depth,effectively solve substantive disputes through the litigation process and achieve fairness and justice.
