摘　　要：地方立法委托第三方起草制度在理论上有诸多优势功能,但实际效果却呈现出正负双面评价结果并存的现状。第三方的组织形态是否多元,能否形成优势互补;第三方选择过程是否公开;第三方在起草过程中与立法部门和社会公众能否良性互动,对起草结果的评价主体是否独立客观、评价标准是否科学、违约责任是否明确都会对起草实效产生不同的影响。未来应针对这些影响因素,扬长避短进行制度设计,使委托第三方立法起草切实发挥其功能优势。Local legislation entrusts the third party drafting system to have many advantages in theory,but the actual effect shows both positive and negative two-sided evaluation results existing.Third party's organization form is plural,can form advantage complementation;Whether the third-party selection process is public;Whether the third party interacts well with the legislative and social public in the drafting process,whether the evaluation subject is independent and objective,whether the evaluation criteria are scientific and whether the liability for breach of contract is clear,will have different effects on the drafting effectiveness.In the future,we should design the system in order to make the commissioned third-party legislation to give full play to its functional advantages.
