摘　　要：规则体系论即“法律是由规则组成的体系”命题,是法理学领域中公认的教条。该命题可以分为两个相对独立又相互关联的命题,即法律的最小单元是“规则”与法律是由规则组成的内部融贯的体系这两个分命题。作为一个前科学的概念,在社会科学研究的语境中,法律规则论遭遇了规则与具体法律实践脱节的困境,也阻碍了对法律进行进一步的社会科学的分析与观察。将法律的基本单位界定为“法律事件”能够有效克服法律规则论所遭遇的难题,进而促使社会科学分析将法律的“系统性”与整体性理解为“法律事件”之间的某种条件化的和具有自我指涉性质的关系,从而既能够克服法律规则论在社会科学分析方面的局限性,也能够超越社会行动理论在分析和处理法律等现代“复杂巨系统”中遇到的方法论困境。这为一种基于中国现实的法社会学研究开拓了全新的路径与可能性。The theory of system of rules,i.e.the proposition that Law is a system of rules,is well accepted by legal scholars in the field of jurisprudence.This proposition comprised by two relatively independent but also related subpropositions:the fundamental unit of law is a rule,and the law is a coherent system of rules.As a prescientific idea,in the context of social sciences research,the theory of legal rules encounters a difficulty of gap between rule and conerete legal practice,and hinders further analysis and observation of the law from the perspective of social sciences.If the foundational unit of law is determined as a legal incident,the difficulties encountered by the theory of legal rules can be efectively overcome,then pushing social science analysts to understand the systematicity and entirety of law as certain kind of conditioned and self-reference relations among legal incidents,thus not only overcoming the limitation of the theory of legal rules in social science analysis,but also surmounting the methodology difculty encountered by the theory of social action in analyzing and dealing with modern complex and gigantie system such as law.This opens up a new way and possibility for a kind of legal sociology research based on Chinese reality.
