摘　　要：律学是中国式的法学,是古代法律人实践智慧的结晶,发掘中国传统法文化中的优秀传统,无论如何也绕不开律学。中国传统律学不仅是释律的学问,而且是关于如何制律、用律的学问。古代律学家们发明了许多创制律典的方法,其中,比较有代表性的有"例分八字"方法、"比附"方法。中国传统律学的发展轨迹呈波浪式,经历了两个明显的上升期:第一个上升期自战国始到北宋止,顶点是北宋,而非唐代;第二个上升期在明清时期,顶点是清代,清代律学代表我国传统律学发展的最高水平。在中国传统律学发展过程中,经学虽然起了很大的推动作用,但在律学发展的起始点上,并未受经学的影响;明清时期甚至出现了律学与经学日渐疏离的现象。中国传统律学虽有很多缺陷,但其发明的律学方法至今仍有借鉴意义。Legal dogmatics is a kind of Chinese style jurisprudence,and a crystal of ancient Chinese legalists'practical wisdom.If we want to dig out the excellent tradition from Chinese traditional legal culture,we can't leave out legal dogmatics.Chinese traditional legal dogmatics is not only a kind of knowledge of explaining the law,but also of lawmaking and applying the law.Ancient Chinese legalists had invented a lot of arts of lawgiving to formulate the code,such as"Eight Words in Chinese Ancient Law Code"(例分八字),analogy(比附),etc.The developing tract of Chinese traditional legal dogmatics is wave-like,and have two explicitrising stages:the first period is from warring states period to North Song Dynasty,and the vertex of which is in North Song Dynasty,not in Tang Dynasty;the second rising stage is in Ming and Qing Dynasties,and the vertex of which is in Qing Dynasty,and legal dogmatics in Qing Dynasty stands for the highest level of our traditional legal dogmatics.Though the study of Confucian classics had played a great role in the process of the development of legal dogmatics,but in the warring states period,legal dogmatics has not affected by Confucian classics,and in Ming and Qing Dynasties,there is a phenomenon that legal dogmatics begin to alienate the study of Confucian classics.In sum,though there are a lot of imperfections in Chinese traditional legal dogmatics,but legal methods invented by ancient Chinese legalists still have uses for reference.
