摘　　要：网络技术的发展对传统消费模式造成了巨大的冲击,跨境网络消费在给消费者带来便利的同时,也产生了一系列消费者合同法律适用问题。作为网络消费大国,中国与世界电子商务往来密切,但现有的《涉外民事关系法律适用法》四十二条却未对网络涉外消费者合同的法律适用加以特殊说明。与此同时,欧盟与美国作为两个较为成熟的法域,已在立法和司法实践上对此类问题作出了回应。基于此,我国应从中吸取经验,立足本土,对传统连接点进行革新,在有限制的“意思自治”原则、“特征性履行”原则和“最密切联系”原则下,从网络涉外消费者合同当事人缔约能力、合同实质要件、形式要件及合同准据法的适用范围四个方面,对我国《涉外民事关系法律适用法》四十二条作出相应的司法解释,完善网络消费者合同领域相关立法。The development of network technology has caused a huge impact on traditional consumption patterns.Cross-border network consumption not only brings convenience to consumers,but also creates a series of issues on legal application of consumer contracts.As a major online consumer country,China has close contacts with the world's e-commerce,but the existing Article 42 of the Law of Law Application of Foreign Civil Relations does not provide a special explanation for the legal application of online foreign-related consumer contracts.At the same time,the EU and the United States,as two more mature jurisdictions,have responded to such issues in legislation and judicial practice.China should learn from the experience,and innovate the traditional connection points based on the national conditions.Under the principle of limited"autonomy of will","characteristic performance"and"the most significant relationship",the corresponding judicial interpretation to Article 42 of China's Law of Law Application of Foreign Civil Relations is provided,and the relevant legislation in the field of online consumer contracts is improved from the aspects of the contracting ability of the parties,the essential elements,the form elements,and the application scope of the applicable law of the contract.
