摘 要:国民政府时期,立法院作为最高立法机构一度接受提请者的法律解释请求,针对法律实施过程中的疑问,通过议决法律解释案的方式解释法律。但此种解答法律疑义方式的立法解释制度最终因与司法机关职掌法律解释的世界法制潮流相悖,与司法院统一解释法令制度界限不明、功能重叠以及在理论与实践上存在室碍而废止。历史证明,法律解释权不能为立法机关所垄断,独立的立法解释制度亦无存在之必要。当前我国的全国人大常委会立法解释制度亟须在解释权的定位、配置及行使方式上进行变革。During the period of national government,the legislative yuan as a full-time top legislature once accepted the legal interpretation requests,and made legal interpretation by way of approving legal interpretation cases.The legislative interpretation system was abolished for the reasons that it was contrary to the world legal trend that the interpretation power charged by the judicial organs,the legislative interpretation power canrt be clearly divided from the uniform interpretation power of the Judicial Yuan,the functions of legislative interpretation were overlap with the uniform inteq^retation,and the existing obstacles in theory and practice.History proves that the power of legal interpretation cannot be monopolized by the legislature,and the independent system of legislative interpretation is not necessary.At present,the legislative interpretation system led by the standing Committee of the National People Congress of our country needs to reform in the orientation,disposition and exercise of the interpretation power.
