摘　　要：截至2019年12月31日,最高人民法院已发布24批共计139例指导性案例。本文以139例指导性案例作为研究对象,以"北大法宝-司法案例库"中的裁判文书作为数据样本,使用大数据分析的方法,从不同视角和维度对指导性案例发布和应用情况进行数据应用及比较研究。对比以往报告,本次新增审理法院、援引类型及应用结果的具象化分析,更为直接地反映出指导性案例的发布和应用现状,以呈现2019年度指导性案例司法应用的变化,为我国指导性案例的司法应用发展提供参考。As of December 31,2019,the Supreme People's Court had issued 139 guiding cases in 24 groups.Using the 139 guiding cases as the subject of research and the adjudicative instruments in the PKULAW.CN Judicial Case Database as data samples,this paper studies the data application and conducts a comparative research on the issuance and application of guiding cases from various angles through big data analysis.Different from previous reports,concretization is applied in this report to the analysis of trial courts,invocation types and results of application to more directly reflect the current status of issuance and application of guiding cases,show the changes of application in judicial proceedings of guiding cases in 2019,and provide references for the development of application in judicial proceedings of guiding cases in China.
