摘 要:随着无人潜航器投入使用,海洋科技发展与法律规则之间的矛盾逐渐激化,威胁着沿海国国防安全和海上交通安全。无人潜航器具备船舶属性,是海事法律的调整对象。但是由于立法的局限性所造成的规则本身缺陷,无人潜航器难以满足海事法律的具体要求,同时也存在一些法律空白。这一方面为沿海国对无人潜航器的维权处置行动提供了治理依据,同时也预示着海事法律须进行更新重塑以适应新科技所带来的实践需求,发挥法律的引领作用。The use of unmanned underwater vehicles will intensify the contradiction between the development in marine science and technology and law,thus challenging the national defense security of coastal states and the safety of maritime traffic.Unmanned underwater vehicles possess vehicle status,which is the object of admiralty law.However,for the inherent vice of rules resulted from the limitation of legislation,unmanned underwater vehicles do not comply with the requirements of admiralty laws and fall into legal limbo on some occasions.This on one hand justifies the measures of coastal states to safeguard their marine rights and interests,on the other hand heralds the renewing and upgrade of admiralty law to meet the practical requirements of new science and technology,so as to play a guiding role of law.
