摘　　要：行政救助法治化是行政救助形成完整体系、行政救助长效化和精准化的前提条件,而目前我国行政救助主要由政策调整,行政救助诸多主体非严格意义上的法律主体,行政救助的内容不确定,行政救助遴选方式不确定,说明我国行政救助法治化程度不足。为此,必须对行政救助进行法律构造,使之实现长效化。主要表现为赋予行政救助主体法律人格、行政救助内容具备法律客体属性,确立行政救助实施的法律程序和行政救助保障的法律监控。行政救助法治化的实现还要求立足于给付行政的行政法理念、制定统一的行政救助法、完善行政救助的具体规则、建立行政救助的诉求机制。The legalization of administrative assistance is the prerequisite for the formation of a complete system of administrative assistance,the long-term effectiveness and the precision of administrative assistance.At present,administrative assistance in China is mainly adjusted by policies,and many administrative assistance entities are not legal entities in a strict sense.The content of administrative assistance is uncertain,and so is the selection method of administrative assistance,which shows that the legalization of administrative assistance still lags behind.To change this situation,it is necessary to legally structure administrative assistance to achieve long-term effectiveness,by giving legal personality to administrative assistance entities,giving legal object attributes to the content of administrative assistance,and establishing legal procedures for the implementation of administrative assistance and the legal monitoring of administrative assistance guarantees.The implementation of the legalization of administrative assistance should also be based on the administrative law concept of welfare administration,the formulation of a unified administrative assistance law,the improvement of specific rules for administrative assistance,and the establishment of an appeal mechanism for administrative assistance.
