关于加快构建国家生物安全法治体系的若干思考

摘　　要：文本旨在以习近平总书记在中央全面深化改革委员会第十二次会议发表的关于尽快推动出台生物安全法、构建国家生物安全法律法规体系和制度保障体系的重要讲话精神为指导,结合我国学术界既往对国家生物安全以及相关法律和立法问题的研究成果,围绕正在审议的《中华人民共和国生物安全法(草案)》的各项规定,从完善国家安全法律制度的角度出发,提出加强国家生物安全立法、构建国家生物安全法治体系的具体学术方案和政策建议。文本认为,《中华人民共和国生物安全法》真正要解决的问题是如何把法治原则有效地贯彻到国家生物安全的各个适用领域,必须要将以人为本、维护国家安全、维护生态平衡、保障基本人权、保证技术风险可控和构建人类命运共同体等法治原则作为立法的指导思想,在此基础上提出可以从理论和价值体系、法律规范体系和制度保障体系三个角度构建国家生物安全法治体系、统筹国家生物安全领域的各项法治工作,以促进国家生物安全工作和活动的法治化,提高国家生物安全治理能力。While presiding over the 12th meeting of the Central Committee for Deepening Overall Reform,President Xi urged efforts to include biological safety in the national security system.Guided by his speech,this article reviews the previous research on national biosafety and related legislation in China and puts forward research measures and policy suggestions to strengthen the national biosafety legislation and construct the national biosafety legal system,focusing on the provisions of the“Biosafety Law of the People’s Republic of China(Draft)”,which is currently under discussion.This paper holds that the critical problem to be solved in the Biosafety Law is to implement the rule of law in all fields of national biosafety.To do so we must be people-oriented,safeguard national security,maintain ecological balance,protect basic human rights,control technological risks and endeavor to build a human community of shared future.We conclude that we need to institute our national biosafety legal system on strong theoretical,legal and institutional basis.
