摘　　要：1992年欧盟《栖息地指令》建立了泛欧洲自然保护区网络——"Nature 2000"。该指令第六条确立了涉自然保护区规划和项目审批制度,要求所有可能对保护区造成重大影响的非管理措施类规划和项目遵守统一的审批程序,包括适当评价、基于公众意见和评价结论的决策以及审批例外规则三个递进步骤。我国可借鉴欧盟立法提供的有约束力的前置程序、充分的公众参与和严格的涉公共利益活动例外规定三方面经验,完善涉及自然保护区规划和项目审批制度。EU Habitats Directive set up a coherent European ecological network of special areas of conservation under the title Nature 2000.Article 6 of the Directive provides a step-by-step permit procedure for plan or project affecting Nature 2000 sites,aiming to balance the ecological interest and interests of social or economic nature.Appropriate assessment should firstly be taken to identify the plan or project's negative influences on Nature 2000 sites,decision making procedure should guarantee public participation,and the derogation regime must be applicated under strict conditions and only for protecting overriding public interests.
