人民币国际化进程中金融法律制度构建研究——以日元和德国马克为例

摘　　要：人民币国际化是我国经济发展水平不断提高、国际地位不断提升的新要求,是我国参与国际货币体系,提升话语权的重要举措。构建与人民币国际化相称的国内金融法律制度,在人民币国际化进程中有着不可轻忽的作用。以日元和马克的国际化进程中金融法律制度构建的经验与教训为参考,立足中国人民币国际化的特殊条件和背景,我国可以从渐进式全方位的改革推动金融市场自由化、建立重视国际合作的综合型的金融监管机构、立法提高中国人民银行的独立性这三个重点推动人民币国际化进程中金融制度法律框架的构建。RMB internationalization is a new requirement of our country’s economic development and rising international status.It’s also an important measure of participation in the international monetary system and to enhance discourse.The role of constructing legal system of finance which is suitable for RMB internationalization cannot be ignored.Reference to the experiences and lessons of the construction of financial legal system in the process of internationalization of the yen and the mark,combined with special conditions and background of RMB internationalization,our country can promote to build the financial legal system in the process of RMB internationalization from three focus:promote financial market liberaliza-tion with gradual and all-round reform,establish a comprehensive financial regulatory agency which attaches importance to international cooperation,and legislate to improve the independence of the People’s Bank of China.
