摘　　要：以基本原则的结构性功能为起点,社会救助制度基本原则需要向上承接社会救助法保障生存权的目的性价值,向下统摄社会救助给付规则。当下《社会救助暂行办法》第二条之规定构成我国社会救助基本原则的基础表达。但在新一轮社会救助法的立法过程中,社会救助基本原则无须表达诸如"公平、公正"等作为"一般法律思想"的最高层级的法律原则,而应该结合社会救助立法目的、聚焦社会救助法律规范,寻找可以作为司法裁判准则的基本原则。因此,我们可以考虑从最低生活保障原则、帮助自立原则及审查核实原则三个维度进行立法表达。From the structural function of basic principles,the basic principles of social assistance law need to express the purpose of social assistance law to guarantee the right to subsistence and guide the rules of social assistance payment.Inter-im Measures for Social Assistance constitutes the basic expression of the basic principle of social assistance in China.There are the highest legal principles of"general legal thought,"such as"fairness,justice,"which doesn't stipulate in social as-sistance law.We should combine the purpose of social assistance legislation,focus on the legal norms of social assistance,and seek for the basic principles that can be used as judicial standards.we shuould consider the legislative expression from three dimensions:the principle of subsistence allowances,the principle of promoting self-reliance and the principle of veri-fication.
