公序良俗原则在台湾法院认可大陆法院判决实务中的适用

摘　　要：不违背公序良俗是台湾地区"两岸人民关系条例"规定的台湾法院认可大陆法院裁判最核心的实质要件。就台湾司法实务观察,公序良俗违背不仅包括裁判实体问题,还包括诉讼程序问题。目前,台湾法院认为大陆法院判决违背台湾地区程序法上公序良俗的情形,主要包括败诉之被告未应诉且未经合法送达、无诉讼行为能力的台湾当事人未经合法代理以及大陆法院无管辖权三个方面。台湾法院认为大陆法院判决违背台湾地区实体法上公序良俗的情形,主要包括大陆法院离婚案件判决基础存在问题、大陆法院判决前一方当事人已死亡而法院仍为判决以及大陆法院判决适用法律与台湾地区相关规定相悖三个方面。Non-breach of Taiwan public order and good customs is the most important essential condition for Taiwan court's approval of the mainland court's judgment according to the Regulations on Cross-Strait People's relations.As far as the judicial practice of Taiwan is concerned,the violation of Taiwan'public order and good customs includes not only the issue of judicial entity,but also the issue of lawsuit procedure.At present,the Taiwan Court holds that the judgment given by the mainland court on those violating Taiwan public order and good customs in procedure law of Taiwan mainly include the fol-lowing three aspects:the defendant who loses the lawsuit does not respond to the lawsuit and has not been legally served,the Taiwan party who has no capacity to act has not been legally represented and the mainland has no jurisdiction.Whereas the Taiwan Court holds that the mainland court's judgment on those who breach the public order and good customs in Taiwan's substantive law mainly embraces the problems in the judgment basis of the mainland court's divorce cases,the death of the former party before the mainland court's judgment and the conflict between the applicable law of mainland court's judgment and the Taiwan civil and commercial laws.
