摘　　要：国际贸易术语是国际经贸活动中普遍采用的国际惯例之一,是全球国际贸易不断发展的主要推动因素之一,并对贸易商等业者的业务操作发挥重要的指导作用。国际商会再次对其予以修订,修订后的贸易术语规则称为Incoterms■2020,以适应客观形势变化的需要。此次贸易术语的修订,其主要变化为:FCA下已装船提单的使用;CIF与CIP下须投保不同的险别;在EXW、FCA、DAP、DPU及DDP下可使用买方或卖方自有运输工具运送货物;将DAT修改为DPU;买卖合同与其附属合同的关系等。本文对其十一种贸易术语下,贸易商等业者如何从风险、运输、保险、单据及海关手续等角度考量,采取既合理地维护自身利益,同时也能为对方所接受的相应策略提出建议,以确保减少纠纷,促进贸易顺利进行。International trade terms are one of the international conventions commonly used in international economic and trade activities.It is one of the main driving factors for the development of global international trade,and plays an important guiding role for traders and other businesses.International Chamber of Commerce(ICC)revised it again to meet the needs of changes in the objective situation,and the new version of international trade terms are Incoterms^®2020.The main change in this revision is the use of loaded bills of lading under FCA;different risks must be insured under CIF and CIP;the buyer or seller can use their own transportation facility to deliver goods under EXW,FCA,DAP,DPU and DDP;modification of DAT to DPU;relationship between the sales contract and its subsidiary contracts,etc.Under the eleven trade terms in Incoterms^®2020,this paper discusses how traders and other practitioners should consider from the perspectives of risk,transportation,insurance,documents,and customs procedures to reduce disputes,ensure smooth trade,and take corresponding strategies to protect their own interests.
