摘　　要：我国学界和司法实践中通常是从刑法理论、医药制度、商业贿赂犯罪构成、犯罪预防等方面研究医药行业商业贿赂问题。本文主要是用实证研究的方法,通过对2019年的100份相关案例分析其罪的特点、危害等现状。基本结论为医药行业商业贿赂犯罪的罪名主要集中在受贿罪,行为方式主要是给付现金或购物卡等财物,犯罪环节绝大部分在医药购销环节。In our academic circles and judicial practice,we usually study the issue of commercial bribery in the pharmaceutical industry in terms of criminal law theory,medical system,commercial bribery crime composition,crime prevention,etc.This article mainly uses empirical research methods to analyze its crime characteristics,harm and other status quo through 100 relevant cases in 2019.The basic conclusion is that the crimes of commercial bribery crimes in the pharmaceutical industry are mainly concentrated in the crime of accepting bribes,and the behavior is mainly to pay cash or shopping cards and other properties.Most of the crimes are in the purchase and sale of medicine.
