新冠肺炎疫情下行政征用之法律规制——以大理市“征用”重庆市口罩为例

摘　　要：新冠疫情中大理市征用重庆市口罩的事件,凸显出我国在突发事件中行政征用存在主体不清、程序不完善以及征用范围过大的问题。突发事件中行政征用应当从征用主体、客体、程序以及征用后补偿等方面进行完善:征用主体中政府部门应仅包含应急管理局(厅),程序上需经启动批准等必要程序,征用范围应当明确免于征用的对象。Dali city’s using of masks of Chongqing during the COVID-19 epidemic highlights the problems of unclear subjects,incomplete procedures and excessive scope of administrative requisition in emergencies in China.Administrative requisition in emergencies should be improved from the subject of requisition,objects,procedures and compensation after the requisition.The subject of requisition should only include the emergency management bureau(office),the necessary procedures such as start-up and approval are required,and the scope of requisition should be clear about the objects prohibited.
