摘 要:就欧洲历史叙事体系的构建而言,中古早期高卢奴隶制一直是其不可或缺的关键内容之一。针对该制度的历史沉浮,学术界通常从社会经济层面进行深度剖析与细致解读,而对法兰克教会在此过程中所起作用的考察则显得不够充分。实际上,在对法兰克教会法及其他相关材料进行关照性分析后不难发现,借由教务会议,法兰克教会不仅将颇为复杂的"奴隶人性"概念通俗易懂且形象生动地展现出来,而且对奴隶境遇进行着有条不紊且显而易见的改善。更为重要的是,在权衡"人类平等"与"上帝分配"的过程中,法兰克教会以一种相对平和的方式在奴隶主和奴隶之间建立起一种新的共识,从而为法兰克国家封建生产方式的形成与发展提供了切实有效的实践模版与理论指南。The Gallic slavery in the early Middle Ages has always been regarded as an indispensable part of the European historical writing.The academic community usually pays much attention to the socioeconomic factors and rarely considers the role of the Frankish Church in the rise and fall of the slavery system.By a cross-examination of the Frankish canons and other related materials,one would find that the Frankish Church Councils not only tactfully promoted the rather complicated concept of“humanity of slaves”in much simple language,but also systematically and substantially improved the slaves’situation.More importantly,in balancing human equality(aequalitas)and the divine dispensation(dispensatio),the Frankish Church established a new consensus between the slave owners and their slaves in a relatively peaceful way.This provided an effective model and theoretical guide for the formation and development of Frankish Kingdom’s feudal mode of production.
