底土资源立法研究

摘　　要：底土资源涵盖种类多,资源利用方式和管理监督涉及多部资源法律法规。底土资源管理不仅要考虑底土资源利用经济利益和公共利益,同时也需要填补管理空白完善制度体系。本文介绍底土资源的基本概念与范围,对比近代晚清末期,美国、澳大利亚、俄罗斯立法经验,整理目前我国的底土资源相关法律法规,对现行法律中有关底土资源的《矿产资源法》《物权法》《水资源法》《资源税法》等进行分析和评价。最后提出关于实践我国大资源统一管理理念的具体建议,包括明确底土资源的法律概念,构建底土资源规划和储量管理制度,完善底土生态补偿制度。通过对底土资源规划、底土资源权属、资源立法、具体行为规范等方面的探讨为相关底土资源立法修法工作提供参考。There are many types of subsoil resources,and resource utilization methods and management supervision involve many resources laws and regulations.The management of subsoil resources must not only consider the economic and public interests in the utilization of subsoil resources,but also fill the management gap and improve the institutional system.This article introduces the basic concept and scope of subsoil resources,compares the legislative experience of the late Qing Dynasty,the United States,Australia,and Russia,and collates the current laws and regulations on subsoil resources in China.This article analyzes and evaluates The Mineral Resources Law,The Property Rights Law,The Water Resources Law,and The Resource Tax Law,etc.on the subsoil resources in the current law.Finally,it puts forward specific suggestions on the practice of the unified management of large resources in China,including clarifying the legal concept of subsoil resources,constructing a subsoil resource planning and reserve management system,and improving the subsoil ecological compensation system.Through discussions on the planning of subsoil resources,ownership of subsoil resources,resource legislation,specific code of conduct,it provides a reference for the related legislative amendments of subsoil resources.
