摘 要:近20年来,各国引渡制度出现了一些值得借鉴的立法改革和司法经验,我国在引渡合作中也遇到一些新问题并摸索出一些行之有效的做法。因此,需要适时地对现行的《中华人民共和国引渡法》进行修订,特别是考虑增加关于简易引渡程序的规定;增加我国主管机关代表请求国参加引渡诉讼并支持相关引渡请求的程序规定;在对外国引渡请求的审查中改变目前"一票否决制"的某些规则,允许请求国及其诉讼代理人针对不引渡的决定提出申诉;将国家监察委员会增补为我国引渡合作的主管机关,并且明确表述在主动引渡中可以向被请求国作出关于在引渡后不判处或者不执行死刑的保证。In the past two decades,there have been some legislative reforms and judicial experiences in the extradition system of various countries.China has also encountered some new problems in extradition cooperation and has found out some effective measures.The current Extradition Law of China needs to be revised in time.In particular,considerations should be given to adding articles about extradition simplified,adding the procedural articles that the competent authorities of China to participate in extradition proceedings on behalf of the extradition seeking country and support relevant extradition requests,altering rules of current"one vote veto"system in the review of extradition requests and allowing the extradition seeking country and its agents to appeal against the decision not to extradite,adding the National Supervisory Commission as the competent authority of extradition cooperation,and clearly stating that in the case of active extradition,a guarantee can be given to the extradition sought country that the person will not be sentenced or executed death penalty after extradition.
