摘 要:随着《民法总则》的颁行和民法典的编纂进程,民事法律体系化问题成为学者们日益关注的焦点。根据立法者原意,《民法总则》通过第128条特别链接条款,将"消费者"概念纳入了民事法律体系,进而确立了《消费者权益保护法》的民事特别法地位。但这一立法举措是否合乎民事法律体系化的要求,却存有疑问。本文以公、私法的划分为切入点,通过对《消费者权益保护法》的定性,以及与德国经验的对比论述,探讨了将"消费者"概念纳入《民法总则》这一立法的不足。因此,为了民事法律体系化的逻辑自洽,未来民法典应不再保留"消费者"这一概念。With the promulgation of the general principles of civil law and the codification process of civil code, the issue of civil law systematization has become the focus of scholars. According to the original intention of the legislator,the general principles of civil law has incorporated the concept of "consumer" into the civil legal system through the special link clause of article 128, and then established the civil special law status of the consumer rights and interests protection law. However, whether this legislation meets the requirements of civil law system is questionable. This paper takes the division of public and private law as the starting point, through the qualitative analysis of the law on the protection of the rights and interests of consumers, and the comparison with the German experience, discusses the deficiency of the legislation of incorporating the concept of "consumers" into the general principles of civil law. Therefore, for the sake of logical self consistency of civil law system, the concept of "consumer" should not be retained in the future civil code.
