论网络个人信息的商业化利用及其治理机制

摘　　要：大数据等新技术的兴起使网络个人信息成为重要的生产资料。信息治理不仅侧重对网络个人信息的保护,更应实现个人信息的合理利用。网络信息本身具有价值属性,通过明确低敏感的个人信息可利用,网络个人信息利用的市场化机制得以建立。作为转让信息的对价,用户获得互联网服务提供者的等偿服务。作为私主体,信息利用双方承担充分披露、等价交易、诚信交易的义务;作为公权力,政府应保护产权和公平交换,并建立起行政救济机制。当前,我国对网络信息的治理应从绝对保护模式转向"信息保护+合理利用"的双轨制,并从倚重用户事前同意转向关注事中事后诚信利用。唯有如此,我国方能在保障用户信息安全和自决的同时,加快数字经济行业对我国经济发展的推动作用,实现网络强国的目标。The advent of big data has witnessed that Internet personal information becomes an important means of production. At present,the governance of information shall not only focus on the protection of personal information,but also pay more attention to create a reasonable utilization mechanism of personal information. Since the Internet personal information has its value,the low-sensitive information could be transactable,thus the Internet personal information trade-off mechanism can be established. The user transfers information,as a consideration,he or she can access to the "free"service provided by Internet service providers. In the transaction process,as the private body,the parties bear the responsibility on the full disclosure,equivalent transaction and good-faith transaction;as a public power,the government should recognize property rights on information,as well as establish a supplementary administrative remedy mechanism. China ’s data governance mechanism should be shifted from the absolute protection model to the "information protection + reasonable utilization"system,as well as from relying on the user ’ consent to focusing on the good-faith transaction process. Only in this approach,our nation can protect the users’ information,accelerate the digital economy industry,and finally achieve the magnificent goal of becoming a real network power.
