摘　　要：2019年政府工作报告指出:我国60岁以上人口已达2.5亿。要大力发展养老特别是社区养老服务业……扩大长期护理保险制度试点。学界对长期护理制度的研究,以经济学、社会学、管理学的成果居多,法学领域的研究成果极少。在阐述长期护理、长期护理保险的相关概念以及长护险的法律关系的基础上,分析了我国长期护理保险制度的法制现状,接着介绍了国外发达国家建立长护险的法制经验及基本内容,最后提出完善我国长护险制度的思考和建议。The Government Work Report 2019 states that China's population over 60 years of age has reached 250 million.It is necessary to vigorously develop old-age care,especially community old-age care services,expanding the pilot of long-term care insurance system.People in the academic world have researched the long-term nursing system from the terms of economics,sociology and management,but the research in the field of law are very few.The article first explains the long-term care,long-term care insurance related concepts,and the legal relationship of long-term insurance.Second,it analyzes the legal status of China's long-term care insurance system,and introduces the legal experience and basic content of long-term insurance in developed countries.Finally,the suggestions on improving China's long-term insurance system are put forward.
