文化线路遗产保护立法的“事理”探究——以丝绸之路为对象

摘　　要：作为世界遗产的一种新类型,文化线路的严格保护与合理利用必须忠于其历史价值和文化价值,这因其复杂性、跨域性以及资源性而挑战艰巨。事理决定法理。作为保障机制,其法律规制需要契合其“事理”。而对文化线路作为遗产共同体或文化综合体等的解析存在歧见,并未在构成要素及其关系结构上科学界定,由此对这一立法前提亟待澄清。以丝绸之路为对象,可知文化线路遗产保护立法不应肢解和归结为物质文化遗产、非物质文化遗产立法等的简单相加,而必须体现文化交流与创新的历史演进与空间延续,体现物质和非物质文化遗产之间的融通与创生,体现以线性分布的诸种文化遗产在其自然环境、文化生态中的景观及其统合、呼应,并应以意义阐释系统及其文化符码、话语表达作为必要构件。基于此,文化线路立法应在跨域协同、遗产一体和整体价值上维护文化线路的特质。这是评价其立法科学性的基准。Taking the Silk Road as the object,we can see that the legislation of cultural route heritage protection should not be divided into the simple sum of material cultural heritage legislation and intangible cultural heritage legislation,the historical evolution and spatial continuity of cultural exchange and innovation must be reflected,the harmony and creation between material cultural heritage and intangible cultural heritage must be reflected,the landscape images of various cultural heritages with linear distribution in their natural environment and cultural ecology and their mutual echo must be embodied and integrated.In addition,the legislation of cultural routes should take the system of meaning interpretation,cultural symbols and discourse expression as a necessary component.Based on this,the legislation of cultural routes should embody the characteristics of cultural routes in cross regional coordination,cultural heritage integration and overall value.This is the benchmark to evaluate the scientific of its legislation.
