论检察机关办案中心观的深化  

On the deepening of case-centered concept in prosecutorial organs

摘　　要：深化检察工作“以办案为中心”的认识,应当正确把握监督与办案之间是内容与形式、本质与现象的辩证统一关系,坚持“在办案中监督,在监督中办案”的理念。检察办案的科学内涵是“实体与程序并重”“打击与保护并重”“刑事与民事(行政)并重”,具有丰富性、监督性、全局性,应当牢固坚持依法独立公正行使检察权和分工负责、互相配合、互相制约的法治原则,促进刑事、民事、行政和公益诉讼检察全面协调充分发展。为适应新时代社会主要矛盾发生的全面深刻变化,要把“以办案为中心”的核心监督观念,深入落实到通过执行严格的办案标准为人民群众提供更多更好的法治产品、检察产品之上。To deepen the understanding of“case-centered prosecutorial concept”,the dialectical unity of content and form,essence and phenomenon between supervision and case-handling should be correctly comprehended,and the concept of integrating supervision into case-handling needs to be followed.The scientific connotation of prosecution is to attach importance to“entity and procedure,fight and protection,and criminal case and civil(administrative)case”,which is diverse,supervisory and all-round.Meanwhile,in accordance with the law,the impartial and independent implementation of prosecution as well as labor division,coordination and mutual restriction should be firmly insisted on,so as to fully develop and promote the cooperation among criminal,civil,administrative and public welfare lawsuit prosecutions.In order to adapt to the comprehensive and profound changes brought by the major social contradictions in the new era,prosecutorial organs should further implement the notion of“case-centered supervision”by providing more and better legal and prosecutorial products to the people via implementing strict standards and taking responsibilities to handle cases.
