重大案件侦查终结前讯问合法性核查制度的缺陷与完善

摘　　要：重大案件侦查终结前讯问合法性核查制度的构建,有利于遏制刑讯逼供等非法讯问行为,完善非法证据排除规则和检察机关的检察监督职能,但是在实践之中,重大案件侦查终结前讯问合法性核查制度尚未出台细化的解释和规定文件,而且没有与之相对应的配套制度帮助其实施,导致在实施过程出现了核查的范围存在争议、核查启动的主体有待完善、核查的方式需要补充、核查的主体缺乏监督、核查的区域管辖存在冲突等问题。通过运用文献分析法和归纳分析法,对其核查的范围、核查启动的主体、核查的方式、核查的主体、核查的区域管辖进行规定和明确进而尝试对重大案件侦查终结前讯问合法性核查制度的完善进行探讨。The construction of a system for examination the legality of interrogation before the end of the investigation of important cases is conducive to curb illegal interrogations such as torture,improving the rules for excluding illegal evidence and the procuratorial supervision function of the procuratorial organization.However,in practice,the legality examination system of interrogation before the end of the investigation of important cases has not yet issued detailed explanations and regulations,and there is no corresponding supporting system to help its implementation.As a result,there are disputes over the scope of the examination during the implementation process.The main body of the examination needs to be improved,and the examination method needs to be supplemented.The main body of the inspection lacks supervision,and there are conflicts in the regional jurisdiction of the inspection.Therefore,by using the literature analysis method and the inductive analysis method,regulating and clarifying the scope of the inspection,the main body of the inspection,the method of inspection,the main body of the inspection,and the area to be inspected jurisdiction,and then attempts are made to explore the improvement of the legality examination system of interrogation before the end of the investigation of major cases.
