摘　　要：随着国际农业投资的发展,海外农业投资者、以地为生的农民和东道国政府之间关于土地权的矛盾日益突出。在现有国际投资法框架下,农民土地权益受到损害时,难以得到东道国国内法的保护。国际社会须推动建立国际农业投资规则,各国在新一代国际投资协定中应补充保护农民土地权的人权条款,土地权受到损害时应积极寻求国际救济途径。With the development of International agricultural investment,contradictions among foreign agricultural investors,host governments and farmers making a living on land are getting increasingly prominent.Host governments find it hard to protect farmers’rights and interests by domestic laws under the pressure of International Investment law.Therefore,the international investment treaties should be supplemented with human rights articles protecting farmers’land rights and interests and the international community promote the establishment of international agricultural investment rules,therefore,the farmers concerned could resort to the international remedy mechanisms.
