论美国对华贸易摩擦的法治反制

摘　　要：美国挑起对华贸易摩擦,经济全球化遭遇霸权主义、强权政治和保护主义的挑战,解决这场反复无常的拉锯战,必须坚持法治思维,坚决依据国际法和WTO规则进行反制。中国有必要建立施行安全管理清单制度,健全创新知识产权保护制度,坚定维护和完善多边贸易体制。法治是共建“一带一路”不可或缺的重要基础和保障,只有不断完善合作国家之间的贸易规则、投资规则、争端解决机制,推进“一带一路”法治共建,才能营造良好法治环境,充分发挥法治的保障作用。中国始终以“开放、协商、合作、共赢”的理念改革创新国际贸易争端解决机制,为推进全球治理体系和治理能力现代化贡献中国智慧与中国力量。The United States has started trade conflicts with China,and the economic globalization is facing challenges of hegemonism,power politics and protectionism.To solve this capricious tug of war,China should stick to the rule of law,and take countermeasuresby following international law and WTO regulations.China should establish a safety management list system,better and innovate intellectual property protection system,and firmly maintain and perfect multi-lateral trade system.The rule of law is an important indispensable foundation and guarantee for the co-construction of“the Belt and Road”.The co-construction of rule of law of“the Belt and Road”should be constantly promoted through trade rules,investment rules and dispute settlement mechanismsamong countries to create a healthy rule-of-law environment and give full play to the guarantee function of the rule of law.China has always reformed and innovated a new international trade dispute settlement mechanism with the ideas of“opening,negotiation,cooperation and mutual benefit,and contributed Chinese wisdom and Chinese power to the promotion of global governance system and the modernization of administrative capability.
