摘 要:自网络拍卖成为司法拍卖程序重要途径以来,拍卖辅助机构需求与日俱增,但辅助机构的管理制度却缺乏统一规范,且各地各自为政的做法引发了不少争议,实质性地阻碍了司法拍卖工作,减损了司法公信力、滋生了司法腐败。为此,应当统一行业管理规范,确定辅助机构的法律性质,明确辅助机构的选聘标准,根据属地管辖分级执行,加强行业监管等措施,在保证行业统一规范管理的同时,充分考虑地域差别,寻求网络司法拍卖辅助机构管理的规范化发展。The need of auction auxiliary organizations increases when internet auction becomes the major method for judicial auction.But the management system of auxiliary organizations is in lack of unified standards and local measures in different districts cause disputes,which actually blocks the judicial auction by decreasing judicial credibility and breading judicial corruption.Thus,it becomes very necessary to unify the business management system,stipulate the legal nature of auxiliary organizations,and clarify selection standards of auxiliary organizations as well as taking district differences into consideration so as to standardize the management of judicial auction auxiliary organizations.
