摘　　要：文章从倒卖车票罪的法益分析对有偿代购行为进行解读,指出小额有价代购行为因其行为不会侵害法益,不宜做犯罪处理,而网络软件抢票本质上剥夺了旅客抢票的自由权,应以倒卖车票罪论处。From the perspective of legal interest analyses of railway-ticket scalping crime,this paper interprets the behavior of paid purchasing.The paid purchasing behavior should not be considered as a crime because there is no infringement of legal interests,while the network railway-ticket-snatching software should be regarded as a kind of ticket scalping crime for it deprives passengers of their freedom to buy tickets.
