Politics and Law Intertwined:An Exploration of the “Li Fuda Case” in the Early Jiajing Period of the Ming Dynasty

摘　　要：嘉靖初年发生的"大礼议",使朝臣之间产生了很大的对立情绪。"李福达案"本来只是一桩发生在地方的讦告案,但因议礼重臣武定侯郭勋致信嘱托,遭到山西巡按御史马录弹劾,竟使这个地方上的案件与朝廷中的政争交织纠缠起来,以致案情发展一波三折,终审结果屡遭质疑,成为明朝历史上的一大疑案。通过梳理此案的来龙去脉和审理过程,可以看出,自马录弹劾郭勋后,此案便上升为广受关注的公共事件,案情审勘不可避免地受到朝廷政争的干扰。对于终审结果,应从两个方面理解:从法律角度看,它确实避免了一桩大冤案的发生;从政治角度看,它又确实成为皇帝和议礼新贵们打击异己的手段。"The Great Ritual Controversy"that happened in the early years of Jiajing,engendered a lot of antagonism among the courtiers.The"Li Fuda Case"was originally a local accusation case,but because Guo Xun,a high-ranking official and Marquis Wuding,wrote to Ma Lu,the imperial itinerant inspector of Shanxi,for advice,and Ma Lu went on to impeach Guo Xun,this local case was intertwined with the political disputes in the court,which caused twists and turns in the development of the case,and the final trial result was repeatedly questioned,making this case a big mystery in the history of the Ming dynasty.By combing the cause and trial process of this case,this paper holds that since Ma Lu impeached Guo Xun,the case had become a public event of wide concern,and the investigation of the case was inevitably interfered by the political disputes of the court.As far as the final result is concerned,we should understand it from two aspects:first,from the legal point of view,it did avoid the emergence of a gross injustice;second,from the political point of view,it indeed became the means of the Emperor and his favorite ministers to fight against their dissidents.
