风险规制视域下环境信息公开制度研究

摘　　要：环境风险规制注重结构开放和主体多元,强调过程性、协商性和互动性,重视社会性监督,具有灵活性、有效性、内生性和低成本等优势。环境信息公开是环境风险规制模式运行的关键性元素和基础性制度,它具有保障多元主体参与环境风险规制,促进企业环境风险自我规制,监督政府环境风险规制绩效的价值目标。基于对环境信息公开法律体系的文本分析,结合环境风险规制的运行逻辑,应完善环境信息公开法律体系,健全环境信息公开披露机制,强化环境信息公开责任机制,建构环境信息公开沟通机制。Environmental risk regulation focuses on structural openness and subject diversity,emphasizes process,consultation and interaction,and attaches importance to social supervision,which has advantages of flexibility,effectiveness,endogenous and low cost. Environmental information disclosure is the key element and basic system of the operation of environmental risk regulation mode. It has the value goal of ensuring the participation of multiple subjects in environmental risk regulation,promoting the self regulation of enterprise environmental risk and supervising the performance of government environmental risk regulation. Based on the text analysis of the legal system of environmental information disclosure,combined with the operational logic of environmental risk regulation,we should improve the legal system of environmental information disclosure,improve the mechanism of environmental information disclosure,strengthen the responsibility mechanism of environmental information disclosure,and build the mechanism of environmental information disclosure and communication.
