摘　　要：在新型冠状病毒肺炎疫情防控中,为减轻医院救治压力,降低人民群众感染病毒的概率,启动了互联网在线医疗服务,确保社会大众医疗服务的安全和现实需求。这也亟须在法律视角下对互联网医疗服务监管给予完善。以疫情防控为出发点,阐述互联网医疗服务在疫情防控中应用的意义,对疫情防控中互联网医疗服务监管面临的困境展开分析。针对互联网医疗服务中监管依据缺失、首诊制约监管错位、医保支付体系监管乏力,探寻完善法律监管的创新路径,提出应加快推进突发疫情互联网诊疗监管的专门立法,建立突发疫情互联网首诊开放法律监管制度,完善疫情防控中互联网医保定价支付与流程监管的应对策略。以期在疫情防控中实现互联网医疗服务法律监管的完善和应用价值的最大化。In the prevention and control of COVID-19,the government quickly launched online medical services to ensure the safety and practical needs of public medical services in order to reduce the pressure of hospital treatment and reduce the probability of Chinese people being infected with the virus.Therefore,it is urgent to improve the supervision of Internet medical services from the perspective of law.Taking epidemic prevention and control as the starting point,this paper expounds the significance of the application of Internet medical service in epidemic prevention and control,and analyzes the difficulties faced by the supervision of Internet medical service in epidemic prevention and control.For lack of regulation in medical service based on Internet,the misplacement of supervision on first diagnosis and control,weakness of regulation of medical insurance payment system,this paper explores the innovative path to improve legal supervision,proposes that we should speed up the special legislation on supervision on Internet diagnosis and treatment of emergencies,establish a legal supervision system on the opening of Internet first diagnosis of emergencies,and improve response strategies of the payment and process supervision on internet medical insurance pricing in epidemic prevention and control.In order to achieve the perfection of legal supervision and the maximization of application value of internet medical services in epidemic prevention and control.
