我国高校学生纪律处分数过并罚制度研究

摘　　要：对高校学生有两个及以上违纪行为需要同时给予纪律处分这一问题,我国高校既缺乏理论研究也缺乏明文规定。为解决这一实务难题,借鉴刑法领域的数罪并罚理论与法律规定,结合高校学生管理体系的特点,以数过并罚的一般原则、“先减后并”“先并后减”的执行处分期计算方法为核心,建立了以数过的认定、并罚的执行及数过的解除为构成要素的高校学生数过并罚体系,以期完善高校学生纪律处分规则体系,指导高校合理行使裁量权,提升高校依法行政水平。In order to solve the problem that two or more kinds of violations need to be punished at the same time,which lacks both theoretical research and unified provisions,this paper set up a system of combined punishment for college students by drawing lessons from the theory and criminal provisions of combined punishment.The three cores of this system are confirmation of the number of violations,the execution of the combined punishment and the release of the punishment.For colleges and universities,this system can help improve their legislation system of student management,enhance their level of administration according to law,guide them to exercise their discretion reasonably.
