突发公共卫生事件中志愿者权益保护问题论

摘　　要：如何全面保障突发公共卫生事件中志愿者的权益不容忽视。我国暂未出台统一的、高位阶志愿者服务立法,仅存一部行政法规及多部地方性法规。针对上述法规中的现状,建议我国建立突发公共卫生事件志愿者服务法,并将突发公共卫生事件中志愿者服务单列一章。加强对非注册志愿者的保护,详细划分侵权责任;志愿者在公共服务活动中如有伤亡,应认定为工伤,通过保险、专项基金、社会保障的有机结合,全方位确保医护志愿者在意外情况下能得到及时救助和赔偿;拓宽非讼救济途径,为志愿者提供免费法律援助,加大权益保障力度。How to fully protect the rights and interests of volunteers in public health emergencies cannot be ignored.China has not promulgated an uniform and high-level legislation of volunteer service.Now only one administrative regulation and many local regulations exist.In view of the current situation in the above-mentioned regulations,it is recommended that our country should establish an Emergency Volunteer Service Law and separate a public health volunteer service chapter.Strengthen the protection of unregistered volunteers,and divide the infringement responsibility in detail.Volunteers who are injured or killed in public service activities should be regarded as work-related injuries.Through the organic combination of insurance,special funds and social security,volunteers will be fully guaranteed and can get timely assistance after infection.Expand non-litigation relief channels and provide free legal assistance to volunteers to ensure that volunteers receive timely relief and spare no efforts to protect their rights.
