摘　　要：网络服务提供者(ISP)市场准入制度是平衡网络经济秩序和数字化产业繁荣的重要砝码,承担着优化网络资源配置、引导网络经营行为、整合ISP网络角色和促进行业发展的重要功能。我国现有的ISP准入制度规则分散、要件冲突、准入方式单一且准入责任不明,因而无法有效实现其功能目标。ISP准入制度的设计的立法理念应当由“管制”转向“引导”,采用“统分结合”相对集中的立法模式,以“社会关系干预度”和“风险领域”相结合的方式,确立多层次准入方式,基于ISP“信息加工深度”设计准入义务规则,以准入方式为主、“利益驱动强度”为补充形成ISP准入条件被违反所导致的责任体系。The internet service provider(ISP)market admittance system is an important counterweight to balance the internet economic order and the prosperity of the digital industry.A scientific and reasonable market admittance system can optimize the function of allocating network resources,regulating the behavior of ISP,integrating the social role of ISP and promoting the development of network services.While the existing legal research almost completely ig⁃nored the ISP market admittance issues,the existing legal norms of ISP market qualifications scattered in so many le⁃gal sources of different effective levels that the standard content provided by different departments,the requirements conflict to each other,the access mode is simple and the responsibility is difficult to describe.The legislation concept of ISP market admittance system should be changed from“regulation”to“guidance”.Adopting the relatively concentrated legislation mode o“f unification,division and combination”,a multi-level access mode should be established by combin⁃ing“social relationship intervention degree”and“risk field”.Based on the“information processing depth”of ISP to de⁃sign the obligation rules of admittance system.The responsibility system is formed mainly based on the admittance methods and supplemented by the“interest-driven intensity”of ISP.
