衍生数据刑法保护进路的多重考察——兼论财产权客体的时代变迁

摘　　要：衍生数据兼具非物质性与财产性,是一种无形的信息财产,区别于物权法意义上的能量型无体物,应将其纳入知识产权客体的范围,其中非公开性衍生数据符合商业秘密的构成要件,而应以公开性衍生数据作为数据专有权的客体。从衍生数据所蕴含的数据安全、个体财产、竞争秩序三重法益内容出发,衍生数据的刑法保护路径可以分为以侵犯计算机信息系统类犯罪为代表的专门化保护模式与以侵犯财产罪和侵犯知识产权罪为代表的财产化保护模式。刑法应分类规制侵害他人衍生数据的不法行为,以电子侵入方式窃取衍生数据的行为构成非法获取计算机信息系统数据罪;非法获取并使用非公开性衍生数据的行为适用侵犯商业秘密罪;对未经许可使用公开性衍生数据的行为增设侵犯数据专有权罪。Derivative data,which has both immateriality and property,is a kind of intangible information property.It is different from the energy-type immateriality in the sense of property law.It should be included in the scope of the ob⁃ject of intellectual property.Among them,the non-public derivative data conforms to the constituent elements of trade secret,and the public derivative data should be regarded as the object of data exclusive right.Starting from the triple legal interests of data security,individual property and competition order contained in derivative data,the criminal law protection path of derivative data can be divided into specialized protection mode represented by crimes of infringing computer information system and property protection mode represented by crimes of infringing property and intellectu⁃al property.Criminal law should classify and regulate the illegal acts of infringing others'derivative data.The act of stealing derivative data by means of electronic intrusion constitutes the crime of illegally obtaining computer informa⁃tion system data;the act of illegally obtaining and using non-public derivative data is applicable to the crime of infring⁃ing business secrets;a new type of crime of infringing data exclusive right is applied to the act of using public deriva⁃tive data without permission.
