摘　　要：一直以来,发展权和其他人权的关系因其复杂性而备受国内外关注,同时亦难以处理。解决问题的关键在于辨明发展权得以区别于其他人权的独特之处,以此作为发展权的标识,并融入促进、实现发展权的过程之中。通过对发展权进行深入分析,可知其特殊性体现在其以幸福生活的导向为主要功能、以发展机会的平等为主要实现途径、以国家层面的集体为主要价值。三者环环相扣,共同树立了发展权在人权体系中的独立地位。这种界定符合了发展权的权利属性、应有之意、全球背景和国家定位,具有合理性。对发展权功能及价值的恰当界定,有助于中国在国内层面更好地促进和实现发展权,在国际层面倡导发展权国际造法中的中国话语。The relation between the right to development and other human rights has always been an attractive but tricky question.To answer this question,it is identifying the special natures of the right to development that plays the key role.Such special natures that the right to development regards orientation of the happy life as its main function,equality of development opportunities as main ways of fulfillment,and collective at the national level as its main value of the right show the identification of the right to development and should be integrated in the process of improving and fulfilling such right.This definition is rational in that it fulfills the nature of rights,proper meaning,global background and state position of the right to development.It is also of benefit not only to deal with the right to development and other human rights precisely,but also to improve and fulfill the right to development in the domestic aspect,interpret the human rights system within a Community of Shared Future for Mankind and establish China’s voice on the law-making process of the right to development.
