摘　　要：受新型冠状病毒肺炎疫情影响,《生物安全法》的草案审核加紧,生物安全立法的目的是使国家、社会、经济、公共健康、生态环境正常发展,不受现代生物技术开发和应用活动侵害或存在潜在风险。生物安全立法的正义价值即保障生物安全领域科研主体和公众的自由与平等;秩序价值体现在控制生物技术的负面影响;效率价值体现在促进社会经济的影响。三者之间是对立统一的关系。在价值排序中,正义价值的优先级应高于秩序价值,秩序价值的优先级又高于效率价值。通过立法明确权利义务可以调适正义价值的内容;通过纳入生物伦理学,在立法时明确道德核心,可以调适经济高速发展需求与生物技术伦理的边界,运用生物安全文化调适生物技术带来的负面影响。Influenced by the novel coronavirus( 2019-nCoV),the review of the draft of the Biosafety Law has been put on the top of agenda. The legislative purpose of biosafety law is to make the state,society,economy,public health,and ecological environment develop normally without being infringed or threatened by the development of modern biotechnology. The justice value of the legislation of biosafety law is to guarantee the freedom and equality of scientific research institute and the public in the field of biosafety;the order value is reflected in controlling the negative impact of biotechnology;the efficiency value is reflected in promoting the influence of society and economy. The relationship among the three is opposite and unified. In value ranking,the priority of justice value should be higher than the value of order,and the priority of order value is higher than the value of efficiency. The justice value can be adjusted by clarifying the rights and obligations through legislation;the boundary between the needs of high-speed economic development and biotechnology ethics can be adjusted by defining moral core in legislation by incorporating bioethics,reducing the negative effect of biotechnology by applying biosafety culture.
