摘　　要：在代表国家行使自然资源所有权的机制中,国务院主导着自然资源的所有权行使,国务院和国务院相关部门从抽象到具象均行使着自然资源的所有权。近年来,虽然自然资源单行法陆续修改,但国务院代表行使国家所有权仍缺乏科学统一的规则体系,国务院与全国人大、地方人民政府等其他国家机构,以及国务院各部委之间的权限划分和权利来源依然模糊。优化国家所有权行使机制,首先,需要在立法层级、内容上实现管理与所有的分离;其次,需要明确国务院授权其自然资源主管部门、地方人民政府,委托相关部门代理行使所有权的依据和形式;最后,国务院具有最广泛的代表权,其权限范围可通过全国人大、各部委和地方人民政府等机构的权限排除法确定。In the system of representing the state to exercise the ownership,the State Council dominates the exercise of the ownership of resources.The State Council and the relevant departments of the State Council exercise the ownership of natural resources from the abstract to concrete.In recent years,although the laws about natural resources have been revised in succession,we still lack a scientific and unified rules system for the State Council to represent the state to exercise the ownership.The division and sources of rights between the State Council and the National People's Congress,local governments and other institutions,as well as ministries and commissions of the State Council are still blurred.To optimize the exercise system of the state ownership,first,we should separate the management and the ownership in the legislative level and content.In addition,we should clarify the foundation and formation that the National People’s Congress authorizes its natural resources department,local governments,and commissions the relevant departments to exercise the ownership.Last but not least,the State Council has the most extensive rights of representation.We can define the terms of rights through eliminating the rights of the National People’s Congress,ministries and commission directly under the State Council,local government and other institutions.
