摘  要:电子商务平台实施的"二选一"行为,引发了学界的广泛关注。在对电商平台"二选一"行为进行反垄断分析时,首先要梳理电商平台中各主体之间的法律关系,把握《反垄断法》与《电子商务法》之间的适用衔接。其次,在对"二选一"行为进行反垄断分析时,应优化滥用市场支配地位认定思路,引入公益诉讼制度以适当减轻原告的举证责任,健全反垄断损害赔偿制度,从而更好地规范网络经济竞争秩序。The implementation of the"one or two"behavior on e-commerce platforms has aroused widespread concerns in the academic circles.To carry out the anti-monopoly analysis on the"one or two"behavior of e-commerce platforms,the first step is to sort out the legal relationships between the main parties in e-commerce platforms,thus accurately grasp the connection between the application of the anti-monopoly law and the e-commerce law.Secondly,the traditional identification methods of relevant markets and market dominance should be improved in the anti-monopoly analysis of e-commerce platform"alternative behavior".The system of public interest litigation should be introduced in the anti-monopoly civil litigation to reduce the burden of proof of the plaintiff,as well establish an anti-monopoly compensation system,so as to better regulate the order of competition in the network economy.
