摘　　要：北魏兰陵长公主被驸马刘辉殴打致死一案对理解古代中国法律儒家化进程的曲折性与复杂性意义重大。主张严惩的当权者将审理此案上升为政治决策,通过特殊审判形式强化皇权对司法的操控,以图政权稳固。反对严惩的改革者具有理想主义情怀,怀着个人好恶迂腐地凭借上官护持和氏族优荣公开反对。然而即便在南朝,北魏高层的审判结论依然会被接受,这是法律儒家化南北进程同样受阻所致。正是秉承儒家礼法伦常,刘辉才敢于一再违逆,酿成惨剧。深究该案所涉人员的想法与行动,他们均受到个人秉性、交际关系和时代观念之影响,各方关联甚密,情感、政治和礼法互相交织,共同制造了这一惨案。从各方关系及其言行动机进一步深入案情,查找案发与裁判及结局的真正动因,方能多元且深刻地解析这一典型案例,进而全面认识古代中国法律儒家化进程。The case of Princess Lanling’s being beaten to death by her husband Liu Hui in the Northern Wei Dynasty is of great significance for understanding how the Confucianization of ancient Chinese law underwent a bumpy journey.Those in power who advocated severe punishment tried to raise the trial of this case to the status of political decision-making,and strengthen the imperial power to control the justice through special trial forms in order to stabilize the political power.Reformers,who had idealistic sentiments mixed with personal likes and dislikes,pedantically relied on the support of their superordinates and the glory of their families,openly opposed severe punishment.However,even in the Southern Dynasties,the conclusions of the Northern Wei trial would be accepted,which was caused by the obstruction of legal Confucianization in both the southern and the northern parts of ancient China.It was the firm belief in Confucian rituals and law that caused Liu Hui’s repeated defiance which finally led to this tragedy.A thorough analysis of the thoughts and actions of the people involved in the case shows that they were all affected by personal nature,interpersonal relationship and the common mindset of that era.The parties involved in the case were closely related,and emotions,politics,rituals and laws were intertwined to create this tragedy.From the relationship between the parties,and their words and deeds,we can find the real causes for the incident,the trial and the ending,and analyze this typical case from diverse and profound perspectives,which will help us develop a comprehensive understanding of the Confucianization of law in ancient China.
