摘 要:著作邻接权制度自其诞生之日起就肩负着保护表演者、录音制作者、广播组织等产业主体利益的功能。囿于催生该制度的传播技术产生的临近性、使用作品的关联性以及作者权制度的理想化坚持,邻接权被披上“作品传播者权”的外衣,也被定性为作者权的附庸,导致邻接权客体的混乱和权利配置的保守。因此,邻接权制度体系的构建必须从功能确认入手,明确邻接权制度保护的是著作权产业领域投资者的投资成果,即无独创性的表达。而邻接权的配置应当以邻接权与著作权地位的平等性为前提,以保护投资者利益为原则,通过客体利用方式的类型化来进行具体权项的设置。Ever since the establishment of neighboring rights system,its function is to protect the investor of copyright industry,such as performers,producers of phonograms and broadcasting organizations.Because of the invention of information communication technology in a short time,the link of works using,and the insistence of authorship theory,the neighboring rights are given the identity of work communicator’s right,and also located as the subsidiary of copyright.Therefore the objects of neighboring rights are chaos,and the contents of neighboring rights are limited.So the establishment of neighboring rights system must begin with the confirmability of neighboring rights’function,which is to protect the production of investor in the copyright industry.The production mentioned before manifest as non-originality express.The neighboring rights must be allocated on the equality of neighboring rights and copyright,and they must protect the interests of investors.The content of neighboring rights is determined by the behavior that using the production of investor in the copyright industry.
