《民法典》离婚财产分割和离婚救济制度的法律适用——以保障农村妇女合法权益为重点

摘　　要：农村妇女权益的保障是我国妇女权益保障的重要一环。以女性主义法学审视法律规范的五个面相为分析工具,《民法典》规定的离婚财产分割和离婚救济制度的法律条款不存在对农村妇女的直接歧视和基础概念构建中的性别歧视,然而由于农村传统习俗的负面影响,村规民约的不适法,以及农村妇女对家庭依赖程度高,农村男性较多外出务工的客观事实,家庭劳动分工的常见模式等因素的影响,离婚财产分割和离婚救济的法律规范对农村妇女存在间接歧视以及在法律推理和法律适用中的歧视。因此,需要对《民法典》中的相关条款进行合理的解释和适用,以促进离婚财产分割和离婚救济在司法实践中对农村妇女特殊权益的保护,强化法律规范在理论和实践中的性别视角,实现男女两性的实质平等。The protection of the rights and interests of rural women is an important part of the protection of the rights and interests of women in China.Using the five faces of legal norms examined by feminist jurisprudence as an analytical tool,the legal provisions of the divorce property division and divorce remedy system provided in the Civil Code do not directly discriminate against rural women and have no gender discrimination in the construction of the underlying concepts.However,the legal norms of divorce property division and divorce remedy indirectly discriminate against rural women and discriminate in the reasoning and application of the law due to the negative impact of traditional rural practices,the inappropriate laws of village rules and regulations,the higher dependence of farm women on the family,the objective fact that farm men are more likely to work outside the home,the common pattern of division of labour in the family and so on.Therefore,the relevant provisions of the Civil Code need to be reasonably interpreted and applied to promote the protection of the special rights and interests of rural women in the judicial practice of divorce property division and divorce relief,strengthen the gender perspective of legal norms in theory and practice,and achieve substantive equality between men and women.
