摘　　要：在动物保护立法问题上,动物福利与动物权利学派一直争论不休,至今未能达成共识。本文从动物福利与动物权利的关系入手,在客观分析动物权利和动物福利争论的基础上,提议应转变立法观念,形成保障动物福利、维护动物基本权利、强调人有动物保护义务的法治理念,并在此理念的指导下,循序渐进进行相关法律变革。本文对于正确认识动物权利与动物福利之争,积极探索双方都能接受的契合点,推动我国动物保护立法具有参考意义。No consensus concerning animal protection legislation has been reached as the animal welfarists and animal rightists have been arguing for a long time. In this paper,considering the relationship between animal welfare and animal rights,and based on the objective analysis on the disputes,it was proposed to change the legislative concept,so as to establish a legal idea including protecting animal welfare,safeguarding the basic rights of animals and emphasizing the obligation of human beings to protect animals. In that case,relevant legal reforms should be carried out step by step. This study was of great significance for recognizing the disputes arising between animal rights and animal welfare,seeking for a common point that both parties could accept,and promoting animal protection legislation in China.
