我国体育仲裁制度分析

摘　　要：体育强国建设的进程中,竞技体育出现了许多纠纷和争端。在这种背景下,体育仲裁作为一种合理的纠纷解决机制,这种机制显得日趋重要。本文透过大量体育纠纷事件以及查阅期刊资料,采用法理分析方法等,从中国现存的体育仲裁背景出发,认真分析我国体育仲裁的情况和特点提出了完善中国体育仲裁体制的建议:常与CAS联系,减少行政干预,多多学习欧美国家的仲裁经验;每年在各个体育行会内部定时进修,强化人才队伍建设;引入司法监管程序并处于动态巡回中;按照实际情况成立一个统一的、完善的,体育仲裁机构。In the process of sports powerhouse construction,there are many disputes in competitive sports.Under this background,sports arbitration,as a reasonable dispute resolution mechanism,is becoming increasingly important.Through a large number of sports disputes cases and data access journals,using research methods such as legal theory analysis,and starting from the background of China sports arbitration,this paper careful analyzes situation and features of sports arbitration in China,and puts forward some suggestions of perfecting China's sports arbitration system:frequent contact with CAS to reduce administrative intervention;learn from European and American countries arbitration experience;carry out timing training in sport guilds annually to strengthen talent cultivation;introduce the judicial supervision procedure and be in the dynamic circuit;as well as establish a unified and perfect sports arbitration organization according to the actual situation.
